MANDAMUS, CERTIORARI AND
PROHIBITION IN CRIMINAL MATTERS

65.01Practice and Procedure
The Rules of Court in force from time to time respecting judicial review, where not inconsistent with
(a) any provision of the Criminal Code, R.S.C. 1970, c.C-34 or any other Act of Parliament, or
(b) any uniform rules of court made by the Governor in Council under subsection 438(5) of the Criminal Code,
apply to proceedings with respect to mandamus, certiorari and prohibition in matters arising under the Criminal Code.

“Pursuant to section 438 of the Criminal Code, the foregoing rule was made by
 
(a)the Court of Appeal of New Brunswick, with the concurrence of a majority of the judges thereof, at a meeting held on July 28, 1981, and
 
(b)the Court of Queen’s Bench of New Brunswick, with the concurrence of a majority of the judges thereof, at a meeting held on August 28, 1981
 
to become effective on the coming into force of the new Rules of Court.”
