Conservation Easements Act

Under section 12 of the Conservation Easements Act, the Lieutenant-Governor in Council makes the following Regulation:
1This Regulation may be cited as the General Regulation - Conservation Easements Act.
2A conservation easement must contain the following information:
(a) the name and mailing address of the holder of the conservation easement and the grantor of the conservation easement;
(b) the rights and privileges granted to the holder of the conservation easement;
(c) the obligations, if any, imposed on the holder of the conservation easement, the grantor of the conservation easement or any subsequent owner of the land to which the conservation easement relates;
(d) the legal description of the parcel of land to which the conservation easement relates sufficient for the purposes of registration in a land registration office and, if the conservation easement only relates to a portion of that parcel of land, a sketch or description of that portion;
(e) the period of time for which the conservation easement is to exist;
(f) the purposes for which the conservation easement is granted;
(g) where land use practices are permitted, restricted or prohibited on the land to which the conservation easement relates, a description of those practices;
(h) the conservation, restoration or enhancement practices, if any, that may be undertaken by the holder of the conservation easement or the grantor of the conservation easement;
(i) the terms and conditions, if any, relating to access by the public or the holder of the conservation easement to the land to which the conservation easement relates;
(j) the allocation of liability between the holder of the conservation easement and the grantor of the conservation easement for personal injury and property damage occurring on the land to which the conservation easement relates; and
(k) the responsibility for costs relating to the conservation easement.
3This Regulation comes into force on September 1, 1998.
