REGULATION 97-122

Community Planning Act

Under subsection 5(2) of the Community Planning Act, the Minister makes the following Order:

1This Order may be cited as the La Vallée Planning District Order - Community Planning Act.
2In this Order
“combined local service district tax base” means the amount that represents the total of the local service districts tax bases of the unincorporated area in the District;
“Commission” means the La Vallée District Planning Commission established under section 4;
“District” means the La Vallée Planning District established under section 3;
“local service district tax base” means local service district tax base as defined in the Municipalities Act;
“Minister” Repealed: 1998, c.41, s.31
“municipal tax base” means municipal tax base as defined in the Municipalities Act;
“rural community tax base” means rural community tax base as defined in the Municipalities Act;
“total tax base” means the amount that represents the total of the combined local service district tax base, the municipal tax base of Grand Falls, Saint-Léonard, Drummond, Village of Sainte-Anne-de-Madawaska and the rural community tax base of Saint-André.(assiette fiscale totale)

3(1)The La Vallée Planning District is established.
3(2)The boundaries of the District are defined as follows:
Beginning at the point where the parish line between the parishes of Grand Falls and Andover meets the international boundary line between Canada and the United States; thence northeasterly along the various courses of the said parish line following the Aroostook River downstream to a point on the parish line between the parishes of Grand Falls and Perth, said point being also in the middle of the Saint John River; thence northeasterly along the said parish line to a point on the parish line between the parishes of Perth and Denmark; thence easterly along the said parish line to a point on the parish line between the parishes of Denmark and Gordon; thence northwesterly and northeasterly along said parish line and continuing northeasterly along the parish line between the parishes of Denmark and Lorne to a point on the county line between the counties of Victoria and Restigouche; thence northwesterly along the said county line and continuing along the county line between the counties of Madawaska and Restigouche to a point on the parish line between the parishes of Sainte-Anne and Rivière-Verte; thence southwesterly along the various courses of the said parish line to a point on the international boundary line; thence southeasterly along the said international boundary line to the point of beginning.

4(1)The La Vallée District Planning Commission is established as the district planning commission for the District.
4(2)The membership of the Commission is ten.

5(1)The members of the Commission shall be appointed as follows:
(a) by the council of Grand Falls, three;
(b) by the councils of Saint-Léonard, Drummond and Village of Sainte-Anne-de-Madawaska, one each;
(b.1) by the rural community council of Saint-André, two; and
(c) by the Minister as follows,
(i) one member representing the local service districts of the parish of Denmark, the parish of Grand Falls and the parish of Drummond, and
(ii) Repealed: 2006-63
(iii) one member representing the local service district of the parish of Notre-Dame-de-Lourdes, the parish of Saint Anne and the parish of Saint-Léonard.
5(2)The terms of office of members of the Commission are as follows:
(a) of the members appointed by the council of Grand Falls,
(i) one member shall be appointed for a term of office expiring March 1, 1998,
(ii) one member shall be appointed for a term of office expiring March 1, 1999, and
(iii) one member shall be appointed for a term of office expiring March 1, 2000;
(b) the member appointed by the council of Saint-Léonard shall be appointed for a term of office expiring March 1, 1998,
(c) the member appointed by the council of Drummond shall be appointed for a term of office expiring March 1, 1999,
(c.1) the member appointed by the council of Village of Sainte-Anne-de-Madawaska shall be appointed for a term of office expiring on March 1, 2002;
(d) Repealed: 2006-63
(d.1) the members appointed by the rural community council of Saint-André shall be appointed for a term of office expiring March 1, 2009; and
(e) of the members appointed by the Minister
(i) one member shall be appointed for a term of office expiring March 1, 1998,
(ii) one member shall be appointed for a term of office expiring March 1, 1999, and
(iii) one member shall be appointed for a term of office expiring March 1, 2000.
5(3)A member of the Commission shall hold office at the pleasure of the Minister, council or rural community council that appointed the member.
5(4)If a member of the Commission dies, resigns, vacates or is removed from office, the Minister, council or rural community council that appointed the member shall appoint another person to replace that member, and that person shall hold office at the pleasure of the Minister, council or rural community council that appointed the member, as the case may be, for the remainder of the term of the member who is replaced.
5(5)On the expiration of the term of office of a member of the Commission, the Minister, council or rural community council that appointed the member shall reappoint the member whose term has expired or appoint a new member for a term of office expiring on the first day of March three years later.

6(1)The proportions in which funds are to be contributed to the Commission by the councils of Grand Falls, Saint-Léonard, Drummond and Village of Sainte-Anne-de-Madawaska, by the rural community council of Saint-André and by the Minister for the unincorporated areas in the district to meet the expenses of the Commission shall be as follows:
(a) by the council of Grand Falls, in proportion to the percentage that the municipal tax base of Grand Falls for the previous year bears to the total tax base;
(b) by the council of Saint-Léonard, in proportion to the percentage that the municipal tax base of Saint-Léonard for the previous year bears to the total tax base;
(c) by the council of Drummond, in proportion to the percentage that the municipal tax base of Drummond for the previous year bears to the total tax base;
(c.1) by the council of Village of Sainte-Anne-de-Madawaska, in proportion to the percentage that the municipal tax base of Village of Sainte-Anne-de-Madawaska for the previous year bears to the total tax base;
(d) Repealed: 2006-63
(d.1) by the rural community council of Saint-André, in proportion to the percentage that the rural community tax base of Saint-André for the previous year bears to the total tax base; and
(e) by the Minister, in proportion to the percentage that the combined local service district tax base for the previous year bears to the total tax base.
6(2)Notwithstanding paragraph (1)(d.1), for the period falling between July 31, 2006, and December 31, 2006, the rural community council of Saint-André shall contribute funds to the Commission in proportion to the percentage that the total of the municipal tax base of the former Village de St. André for 2005 and the local service district tax base for the former local service district of the parish of Saint-André for 2005 bears to the total tax base.
