REGULATION 95-86

Community Planning Act

Under subsection 5(2) of the Community Planning Act, the Minister makes the following Order:

1This Order may be cited as the Rural Planning District Order - Community Planning Act.
2In this Order
“Commission” means the Rural Planning District Commission established under section 4;
“District” means the Rural Planning District established under section 3.

3(1)The Rural Planning District is established.
3(2)The boundaries of the District are defined as all the unincorporated areas of the Province except the following:
(a) the Acadian Peninsula Planning District, the boundaries of which are defined in section 3 of the Order Respecting the Acadian Peninsula Planning District dated April 17, 1979;
(b) the Beaubassin Planning District, the boundaries of which are defined in subsection 3(2) of New Brunswick Regulation 97-139;
(c) the Greater Moncton Planning District, the boundaries of which are defined in subsection 3(2) of New Brunswick Regulation 88-3 under the Community Planning Act;
(d) the Kent County Planning District, the boundaries of which are defined in subsection 3(2) of New Brunswick Regulation 85-36 under the Community Planning Act;
(e) the Madawaska Planning District, the boundaries of which are defined in subsection 3(2) of New Brunswick Regulation 2002-76 under the Community Planning Act;
(f) the Restigouche Planning District, the boundaries of which are defined in subsection 3(2) of New Brunswick Regulation 97-140;
(g) the Tantramar Planning District, the boundaries of which are defined in subsection 3(2) of New Brunswick Regulation 90-24 under the Community Planning Act;
(h) the Belledune Planning District, the boundaries of which are defined in subsection 3(2) of the Belledune Planning District Order - Community Planning Act;
(i) the Miramichi Planning District, the boundaries of which are defined in subsection 3(2) of New Brunswick Regulation 97-46 under the Community Planning Act;
(j) the La Vallée Planning District, the boundaries of which are defined in subsection 3(2) of New Brunswick Regulation 97-122 under the Community Planning Act; and
(k) the Royal Planning District, the boundaries of which are defined in subsection 3(2) of New Brunswick Regulation 98-34 under the Community Planning Act.

4(1)The Rural Planning District Commission is established as the district planning commission for the District.
4(2)The membership of the Commission is five.
5(1)The members of the Commission shall be appointed by the Minister.
5(2)The terms of office of the members of the Commission are as follows:
(a) one member shall hold office until January 1, 1996;
(b) two members shall hold office until January 1, 1997; and
(c) two members shall hold office until January 1, 1998.
5(3)A member of the Commission shall hold office at the pleasure of the Minister.
5(4)When a member of the Commission dies, resigns or vacates or is removed from office, the Minister shall appoint another person to replace that member, and such person shall hold office at the pleasure of the Minister for the remainder of the term of the member who is replaced.
5(5)On the expiration of the term of office of a member of the Commission, the Minister shall reappoint the member whose term has expired or appoint a new member for a term of office expiring on the first day of January three years later.
6The proportion in which funds are to be contributed to the Commission by the Minister to meet the expenses of the Commission is one hundred per cent.
7This Order comes into force on June 16, 1995.
