Under section 17.1 of the Motor Carrier Act, the Lieutenant-Governor in Council makes the following Regulation:
1This Regulation may be cited as the Public Motor Trucks Licensing Policy Regulation - Motor Carrier Act.
2In this Regulation
“Act” means the Motor Carrier Act.(Loi)
3(1)It is hereby established as a policy, to be observed by the Board in the exercise of any jurisdiction or authority conferred upon it under the Act, that the Board shall give every consideration to excluding from licences issued by it between May 1, 1986 and December 31, 1986, both dates inclusive, to public motor trucks all references to specific points beyond the borders of New Brunswick.
3(2)It is hereby established as a rule, to be observed by the Board in the exercise of any jurisdiction or authority conferred upon it under the Act, that licences issued by the Board after December 31, 1986 to public motor trucks shall contain no references to specific points beyond the borders of New Brunswick.
4It is hereby established as a policy, to be observed by the Board in the exercise of any jurisdiction or authority conferred upon it under the Act, that the Board, when requested by an applicant for a licence or by an objector to the granting of a licence to conduct the hearing concurrently with that of authorities having similar powers in another jurisdiction, shall compare the costs and expenses to the parties of separate and of concurrent hearings, and shall give every consideration to conducting concurrent hearings.
