Under section 45 of the Official Languages Act, the Lieutenant-Governor in Council makes the following Regulation:

1This Regulation may be cited as the Interpreters Regulation - Official Languages Act.

2In this Regulation
“court” includes judicial, quasi-judicial and administrative tribunals;(tribunal)
“interpreter” means a person who interprets orally in a manner to be heard by every person present;(interprèter)
“proceeding” means a proceeding in or before a court or before a judge in any matter to which the jurisdiction of the Government or the Legislature of New Brunswick extends.(instance)
3A person may request an interpreter in a proceeding to enable him to proceed or to present evidence in the official language of his choice or to enable his solicitor to represent his interests effectively.
4(1)In a proceeding to which the Rules of Court apply, a request under section 3 shall be made in accordance with the Rules of Court and an interpreter shall be sworn or affirmed in accordance with section 5.
4(2)In a proceeding other than a proceeding referred to in subsection (1), a request under section 3 shall be made to the judge or the presiding officer of the tribunal who shall cause an interpreter to be sworn or affirmed in accordance with section 5.
5Before commencing interpretation in a proceeding, an interpreter shall take the following oath or make the following affirmation:
“I, _________________, do swear (or solemnly affirm)” that I will impartially, and to the best of my skill, knowledge and ability, interpret from one official language to the other official language, those aspects of the proceeding that are presented orally and for which interpretation is required. (In the case where an oath is taken add “So help me God”)”
6This Regulation comes into force on February 1, 1986.
