REGULATION 83-107

Under section 71 of the Registry Act, the Lieutenant-Governor in Council makes the following Regulation:
1This Regulation may be cited as the Forms Regulation - Registry Act.
2An affidavit of transfer shall be in Form 1 and shall contain the following information:
(a) the names of the grantor and the grantee;
(b) the address of the owner of the real property after the date of purchase;
(c) the location and description of the real property;
(d) the true and actual consideration for which the real property was acquired;
(e) the date of acquiring title;
(e.1) a statement that
(i) where the date of acquiring title in a calendar year is before the date a penalty is payable under subsection 10(3) of the Real Property Tax Act, there are no outstanding taxes or penalties on the real property under the Real Property Tax Act as of the end of the previous calendar year, or
(ii) where the date of acquiring title in a calendar year is on or after the date a penalty is payable under subsection 10(3) of the Real Property Tax Act, there are no outstanding taxes or penalties on the real property under the Real Property Tax Act as of the date of acquiring title;
(f) the interest or estate in the real property transferred;
(g) the assessment property identification number;
(h) the assessed value of the real property transferred; and
(i) the mailing address for future real property assessment notices under the Assessment Act for the real property transferred.

3An endorsement by the registrar shall be in Form 2.
4Regulation 82-25 under the Registry Act is repealed.
