Under section 30 of the Fire Prevention Act, the Lieutenant-Governor in Council makes the following Regulation:

1This Regulation may be cited as the Smoke Alarms and Smoke Detectors Regulation - Fire Prevention Act.
2In this Regulation
“approved” means acceptable to the fire marshal;
“bedroom” means any room or space primarily intended for sleeping purposes in a building;
“dwelling unit” means a suite operated as a housekeeping unit, used or intended to be used as a domicile by one or more persons and usually containing cooking, eating, living, sleeping and sanitary facilities;
“institutional occupancy, Group B Division 1” means an occupancy in which persons are detained for penal or correctional purposes or for involuntary detention, or whose liberties are restricted;
“institutional occupancy, Group B Division 2” means an occupancy in which persons, because of age, mental or physical limitations, require special care or treatment;
“mobile classroom” means a self-contained building used for the purposes of providing educational instruction to students and which may or may not be attached to another building;
“National Building Code” means the National Building Code of Canada 2010;
“owner” means any person, firm or corporation controlling the property under consideration;
“residential occupancy” means the occupancy or use of a building or part thereof by persons for whom sleeping accommodation is provided but who are not harboured or detained to receive medical care or treatment or are not involuntarily detained;
“smoke alarm” means a combined smoke detector and audible alarm device designed to sound an alarm within the room or suite in which it is located upon the detection of smoke within that room or suite;
“smoke detector” means a device for sensing the presence of visible or invisible particles produced by combustion and automatically initiating a signal indicating this condition;
“standard” means
(a) 2nd edition of Underwriters’ Laboratories of Canada CAN/ULC S531-02 “Standard for Smoke Alarms”, including Amendment No.1,
(b) Underwriters’ Laboratories of Canada CAN/ULC S552-02 “Maintenance and Testing of Smoke-Alarms”,
(c) Underwriters’ Laboratories of Canada CAN/ULC S553-02 “Installation of Smoke-Alarms”,
(d) National Fire Code of Canada 2010, and
(e) any standard, specification, code or other document referenced by any standard referred to in paragraphs (a) to (d) and in the National Building Code.
“suite” means a single room or series of rooms of complementary use operated under a single tenancy and includes an individual guest room in a motel, hotel, boarding house, rooming house or dormitory.

3This Regulation does not apply to the owner of
(a) a building which is used solely for residential occupancy and in which there are not more than two dwelling units,
(b) tents, or
(c) recreational vehicles.
4(1)Owners of buildings or parts of buildings used for institutional occupancy, Group B Division 1 shall cause an approved smoke detector to be installed in approved locations in or near bedrooms.
4(2)Owners of buildings or parts of buildings used for institutional occupancy, Group B Division 2, where a fire alarm system is not required by the National Building Code, shall cause an approved smoke alarm to be installed in every bedroom on or near the ceiling.
4(3)Owners of buildings or parts of buildings used for institutional occupancy, Group B Division 2, where a fire alarm system is required by the National Building Code, shall cause an approved smoke detector to be installed in every bedroom on or near the ceiling.
4(4)Every smoke detector required by subsections (1) and (3) shall be connected to and shall actuate the fire alarm system of the building.
5Owners of buildings which contain dwelling units shall cause an approved smoke alarm to be installed in each dwelling unit on or near the ceiling in a location between the bedrooms and the remainder of the dwelling unit but that smoke alarm need not be connected to a building fire alarm system.
6(1)Except within dwelling units where smoke alarms are provided as required under section 5, owners of buildings or parts of buildings used for residential occupancy shall cause an approved smoke alarm to be installed on or near the ceiling in every bedroom but the smoke alarm need not be connected to the building fire alarm system.
6(2)Except within dwelling units where smoke alarms are provided as required under section 5, owners of buildings or parts of buildings used for residential occupancy, where a fire alarm system is required by the National Building Code, shall cause an approved smoke detector to be installed in corridors on or near the ceiling and every smoke detector shall be connected to and shall actuate the building fire alarm system.
7Owners of mobile classrooms shall cause an approved smoke alarm to be installed in an approved location on or near the ceiling of each mobile classroom.
8Owners of buildings who are required to install smoke alarms or smoke detectors in the buildings referred to in section 4, 5, 6 or 7 are subject to the following conditions:
(a) smoke alarms or smoke detectors which are connected to the building’s electrical system shall only be connected on a separate circuit without a disconnect switch between the overcurrent protective device and the smoke alarm or smoke detector; and
(b) unless otherwise provided by this Regulation, smoke alarms and smoke detectors shall be located and spaced in accordance with the standards.
9Where any smoke alarms or smoke detectors have been installed in a building, the owner of that building shall cause them to be maintained.
10(1)Smoke alarms and smoke detectors and classes of these devices which have been listed by the Underwriters’ Laboratories of Canada are approved for the purposes of this Regulation.
10(2)Where a smoke alarm or smoke detector has been installed in a building referred to in section 4, 5, 6 or 7 prior to July 1, 1981 and where the smoke alarm or smoke detector
(a) is not listed by the Underwriters’ Laboratories of Canada, or
(b) is not installed according to this Regulation,
the fire marshal may direct that the device and the installation of the device is approved if he is satisfied that it sufficiently complies with this Regulation and the standards.
