Under section 84 of the Local Governance Commission Act, the Lieutenant‑Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Skills and Qualifications RegulationLocal Governance Commission Act.
Definition of “Act”
2In this Regulation, “Act” means the Local Governance Commission Act.
Skills and qualifications of members of the Commission
3For the purposes of section 7 of the Act,
(a) the Chair of the Commission shall, at the time of their appointment,
(i) have experience in local governance or in both local governance and public administration, and
(ii) be able to speak and understand clearly both official languages,
(b) all persons appointed to the Commission shall have training and experience in one or more of the following:
(i) local, regional or board governance;
(ii) municipal law; and
(iii) municipal financial management or administration; and
(c) with respect to the Commission as a whole,
(i) at least one person appointed to the Commission shall be a barrister and solicitor who has been a member in good standing of the Law Society of New Brunswick for at least five years immediately preceding the date of appointment, and
(ii) at least one person appointed to the Commission shall be a member in good standing of the Chartered Professional Accountants of New Brunswick.
Skills and qualifications of members of the Tribunal
4For the purposes of section 59 of the Act,
(a) the Chair of the Tribunal and at least one Vice-Chair of the Tribunal shall, at the time of their appointment, be able to speak and understand clearly both official languages, and
(b) with respect to the Tribunal as a whole,
(i) at least two persons appointed to the Tribunal, including persons acting as alternate members, shall have training and experience in real estate appraisal or property assessment, and those persons shall not hold any other position if that position may result in a conflict of interest when acting for the Tribunal, and
(ii) at least two persons appointed to the Tribunal, including persons acting as alternate members, shall have training and experience in land use planning, and those persons shall not hold any other position if that position may result in a conflict of interest when acting for the Tribunal.
