Under section 86 of the Gaming Control Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Registered Charitable Gaming Suppliers RegulationGaming Control Act.
Definitions
2The following definitions apply in this Regulation.
“Act” means the Gaming Control Act.(Loi)
“bingo equipment” means equipment that(appareil de bingo)
(a) could influence the outcome of a game of bingo, or
(b) is integral to the conduct or management of a game of bingo.
“electronic gaming equipment” means any computer hardware or software used for the sale of a ticket, selection of a winner or distribution of a prize in an electronic raffle. (appareil de jeu électronique)
“electronic raffle” means a progressive or non-progessive licensed lottery scheme in which electronic tickets are sold in the Province for a chance to win a prize in a single draw or a multiple-draw. (tirage au sort électronique)
“registered charitable gaming supplier” means a registered supplier that(fournisseur inscrit de biens ou de services relatifs au jeu de bienfaisance)
(a) manufactures or sells bingo equipment, break open tickets or bingo event break open tickets to licensees and other registered charitable gaming suppliers,
(b) purchases bingo equipment, break open tickets or bingo event break open tickets from another registered charitable gaming supplier and sells them to only one licensee, or
(c) manufactures, installs, maintains, repairs or operates electronic gaming equipment for licensees or provides electronic gaming equipment to licensees.
“test laboratory” means a test laboratory as defined in the Casino Regulation under the Gaming Control Act.(laboratoire d’essai)
Classes
3The classes of registration of charitable gaming suppliers are as follows:
(a) Class 1 – a charitable gaming supplier that manufactures bingo equipment, break open tickets or bingo event break open tickets and sells them to Class 2 registered charitable gaming suppliers, Class 3 registered charitable gaming suppliers or licensees;
(b) Class 2 – a charitable gaming supplier that sells bingo equipment, break open tickets or bingo event break open tickets to licensees;
(c) Class 3 – a charitable gaming supplier that acts as a registered charitable gaming supplier for only one licensee and sells bingo equipment, break open tickets or bingo event break open tickets to the licensee; and
(d) Class 4 – a charitable gaming supplier that manufactures, installs, maintains, repairs or operates electronic gaming equipment for licensees or provides gaming equipment to licensees.
Application fees
4The fees for registration or the renewal of a registration are as follows: 
(a) for a Class 1 registration, $400;
(b) for a Class 2 registration, $400;
(c) for a Class 3 registration, $100; and
(d) for a Class 4 registration, $5,000.
Eligibility for registration
5Only a corporation, partnership or sole proprietorship or an individual who is at least 19 years old is eligible to be a registered charitable gaming supplier.
Validity of registration
6A registration is valid for two years.
Certificate of registration
7(1)If the Registrar registers a charitable gaming supplier under section 37 of the Act, the Registrar shall issue a certificate of registration to the charitable gaming supplier.
7(2)A registered charitable gaming supplier shall prominently display the certificate of registration or a copy of the certificate at the business premises identified in the certificate of registration.
Test laboratory
8For the purposes of this Regulation, a test laboratory is authorized to test the integrity, safety, security and reporting capability of electronic gaming equipment.
Approval of tickets and rules of play
9No registered charitable gaming supplier shall sell break open tickets or bingo event break open tickets to a licensee or other registered charitable gaming supplier unless the Registrar has approved the tickets and the rules of play concerning the tickets.
Approval of electronic gaming equipment
10(1)No registered charitable gaming supplier shall provide, install, maintain, repair or operate electronic gaming equipment unless the Registrar has approved the electronic gaming equipment.
10(2)No registered charitable gaming supplier shall operate electronic gaming equipment except in accordance with the Registrar’s approval.
10(3)No registered charitable gaming supplier shall modify the electronic gaming equipment approved by the Registrar without the prior written approval of the Registrar for the modification, and the registered charitable gaming supplier shall disclose to the Registrar all of the modifications at the time of requesting the Registrar’s approval for a modification.
10(4)In determining whether to approve any electronic gaming equipment under subsection (1) or modifications under subsection (3), the Registrar
(a) shall have regard to the minimum standards established by the Registrar with respect to the integrity, safety, security and reporting capability of the electronic gaming equipment, and
(b) may require that the electronic gaming equipment be tested by a test laboratory with respect to the factors mentioned in paragraph (a) at the expense of the registered charitable gaming supplier.
10(5)Despite subsection (4), the Registrar may approve, without testing, electronic gaming equipment, if the electronic gaming equipment has been approved in another jurisdiction in North America where gaming is legal, but only if the registered charitable gaming supplier provides evidence of the approval and certifies that the electronic gaming equipment complies with the Registrar’s minimum standards for electronic gaming equipment.
Problems with electronic gaming equipment
11(1)If a registered charitable gaming supplier becomes aware of any problem with the integrity, safety, security or reporting capability of their electronic gaming equipment, the registered charitable gaming supplier shall notify the Registrar immediately in writing.
11(2)The Registrar may revoke the approval of any electronic gaming equipment if
(a) there is a problem with the integrity, safety, security or reporting capability of the electronic gaming equipment, or
(b) the Registrar has approved a new version of the electronic gaming equipment.
11(3)If the Registrar is aware of a problem with the integrity, safety, security or reporting capability of any electronic gaming equipment, the Registrar may send the electronic gaming equipment to be tested at a test laboratory at the expense of the registered charitable gaming supplier.
Retention of records
12A registered charitable gaming supplier shall retain the records required under the Act for a minimum period of six years after the date the registration expires, is suspended or revoked or is cancelled on the request of the registered charitable gaming supplier.
Responsibility for conduct of employees
13A registered charitable gaming supplier is responsible for the conduct of every person employed by the registered charitable gaming supplier in the performance of their duties in relation to the registration.
Change of interests
14Within 5 days after any change in the holders of 5% or more of any shares in a corporation that is a registered charitable gaming supplier, the corporation shall disclose the change by filing a disclosure with the Registrar.
ALC
15For greater certainty, this Regulation does not apply to the ALC and the ALC is not a registered charitable gaming supplier.
Commencement
16This Regulation comes into force on October 1, 2021.
