Under subsection 124(1) of the Community Planning Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Fees RegulationCommunity Planning Act.
Definition of “Act”
2 In this Regulation, “Act” means the Community Planning Act.
Fees
3For the purposes of paragraphs 124(1)(c) and (d) of the Act, a regional service commission may charge fees for the community planning and development services provided in a rural district, prescribed as follows:
(a) for providing a zoning confirmation letter, $100;
(b) for providing a letter confirming that a use of land, a building or a structure is in compliance with a planning and development regulation under the Act, $200;
(c) if the power referred to in paragraph 53(2)(i) of the Act is provided for in a regulation respecting rural plans for rural districts and the regional service commission receives an application to authorize a development otherwise prohibited, for processing and considering the application, $250;
(d) if the power referred to in section 55 of the Act is provided for in a regulation respecting rural plans for rural districts and the regional service commission is requested to permit a use or variance, for processing and considering the request, $250; and
(e) if a subdivision regulation under section 125 of the Act is in effect and the regional service commission is presented an instrument, and any plan attached to the instrument, that transfers an interest in land referred to in paragraph 77(1)(l) of the Act, for examining the instrument, $100.

Repeal
4New Brunswick Regulation 2009-31 under the Community Planning Act, chapter C-12 of the Revised Statutes, 1973, is repealed.
