Under subsection 191(1) of the Local Governance Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Procedural By-law RegulationLocal Governance Act.
Definition of “Act”
2In this Regulation, “Act” means the Local Governance Act.
Matters to be included in a procedural by-law
3For the purposes of paragraph 10(2)(a) of the Act, a by-law made by a local government respecting procedures at council meetings shall include the following matters:
(a) the day of the week on which regular meetings of council are to be held and the frequency at which they are to be held;
(b) the time at which regular meetings of council are to be held;
(c) the location at which regular meetings of council are to be held;
(d) the manner of giving notice to members of the public of regular meetings of council;
(e) the rules respecting the behaviour of members of council at meetings of council;
(f) the manner of participating in meetings of council by members of the public;
(g) the method of electing a deputy mayor and the duration of the term of a deputy mayor;
(h) the agenda for regular meetings of council;
(i) the manner of calling special meetings of council;
(j) the procedural text that council is to use to govern matters of procedure that arise during a meeting of council that are not otherwise provided for in the Act or the procedural by-law; and
(k) the use of electronic means of communication in a council meeting or a committee of council meeting.
Repeal of the Procedural By-law Regulation – Municipalities Act
4New Brunswick Regulation 2004-25 under the Municipalities Act is repealed.
