Under section 59 of the Oil and Natural Gas Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Prohibition Against Hydraulic Fracturing Regulation - Oil and Natural Gas Act.
Definition of “Act”

1.1In this Regulation, “Act” means the Oil and Natural Gas Act.

Prohibition against hydraulic fracturing
2No person shall hydraulically fracture a well.
Exemption
2019-17
2.1(1)The Minister may exempt from the application of section 2 any lessee whose lease includes a lease area, in whole or in part, that is located in the sections identified by the numbers 25 to 79 of grid area 2425 in the New Brunswick Standard Oil and Natural Gas Grid Map as set forth in Schedule A of New Brunswick Regulation 86-190 under the Act.
2.1(2)If a portion of a lease area referred to in subsection (1) is located outside of the sections referred to in that subsection, the exemption applies only to the portion of the lease area located in the sections referred to in that subsection.

Offence
3A person who violates or fails to comply with section 2 commits an offence punishable under Part II of the Provincial Offences Procedure Act as a category J offence.
Commencement
4This Regulation comes into force on June 26, 2015.
