Under section 49 of the New Brunswick Community Colleges Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Debts and Other Liabilities Exemption Regulation - New Brunswick Community Colleges Act.
Definitions
2The following definitions apply in this Regulation.
“Act” means the New Brunswick Community Colleges Act.(Loi)
“Special Operating Agency” means the Special Operating Agency defined in section 50 of the Act.(organisme de service spécial)
Debts and other liabilities - exemption
3The following debts and other liabilities are prescribed for the purpose of subsection 53(3) of the Act:
(a) the retirement allowances accrued for employees of the Special Operating Agency as determined under each of the following:
(i) the directive issued by the Board of Management entitled “Termination/Rehire and Retirement Allowance (AD-2407)”;
(ii) the collective agreement in effect between the Board of Management and The New Brunswick Union of Public and Private Employees - Group: Education (Instructional);
(iii) the collective agreement in effect between the Board of Management and The New Brunswick Union of Public and Private Employees - Group: Education (Non-Instructional);
(iv) the collective agreement in effect between the Board of Management and The New Brunswick Union of Public and Private Employees - Group: Administrative Assistants, Clerical and Regulatory, Office, Data Processing and Duplicating Equipment Operation;
(v) the collective agreement in effect between the Board of Management and The Canadian Union of Public Employees Local 1251 - Group: Institutional Services and Care; and
(vi) the collective agreement in effect between the Board of Management and The Canadian Union of Public Employees Local 1190 - Group: General Labour and Trades, Part I; and
(b) the benefits accrued for employees of the Special Operating Agency as determined under the Public Service Superannuation Act.
