Under section 21 of the Public Trustee Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the General Regulation - Public Trustee Act.
Definition of “Act”
2In this Regulation, “Act” means the Public Trustee Act.
Allocating the income earned by a common fund
3For the purposes of subsection 11(4) of the Act, the Public Trustee shall allocate the net income earned by a common fund referred to in section 11 of the Act on a prorated basis to the credit of persons, estates or trusts based on their proportionate ownership of the common fund.
Fees
4(1)The Public Trustee may charge the following fees:
(a) subject to paragraph (c), for any act, duty or service performed under the Act or any other Act or a regulation under the Act or any other Act by the Public Trustee, $75 per hour;
(b) subject to paragraph (c), for any service performed under the Act or any other Act or a regulation under the Act or any other Act by a person employed within the office of the Public Trustee, $75 per hour; and
(c) for legal services performed under the Act or any other Act or a regulation under the Act or any other Act by the Public Trustee or any person employed within the office of the Public Trustee, $150 per hour.
4(2)In addition to the fees provided for in subsection (1), the Public Trustee may charge, for each file,
(a) a file-opening fee of $300; and
(b) an annual administration fee of $100, except in the case of a file opened under the Probate Court Act.
4(3)For the purposes of paragraph (2)(b), the annual administration fee for the year in which the file is opened shall be prorated according to the quarter in which the file is opened.

Commencement
5This Regulation comes into force on June 1, 2008.
