Under section 9 of the Tourism Development Act, 2008, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Tourist Establishment Regulation -Tourism Development Act, 2008.
Definitions
2The following definitions apply in this Regulation.
“Act” means the Tourism Development Act, 2008.(Loi)
“campground” means any area of land upon which camping cabins, trailers, tent trailers, tents, camp trucks, motor homes or similar shelters may be placed to provide sleeping accommodation. (terrain de camping)
“hunting and fishing establishment” means a roofed accommodation that is situated in a location where the services necessary to cater to paying anglers and hunters are provided.(établissement de chasse et de pêche)
“private cottage” means a seasonal residence used primarily for the personal use of the owner and the immediate family of the owner.(chalet privé)
“tourist home” means a private residence that is operated as a roofed accommodation in which shared bathroom facilities may be provided, and includes a bed and breakfast but does not include a private cottage.(maison pour touristes)
Retention of information in register
3The information recorded in a register under subsection 4(1) of the Act shall be kept for a minimum period of 18 months after the date on which the information was recorded.
Exemption from keeping a register
4An owner of a private cottage is exempt from the requirement of keeping a register under subsection 4(1) of the Act.
Exemption from filing an occupancy report
5A person who operates any of the following tourist establishments is exempt from filing an occupancy report under subsection 4(2) of the Act:
(a) private cottages;
(b) hunting and fishing establishments;
(c) tourist homes; and
(d) campgrounds.
Repeal
6New Brunswick Regulation 81-198 under the Tourism Development Act is repealed.
Commencement
7This Regulation comes into force on December 2, 2008.
