Energy and Utilities Board Act

Under section 83 of the Energy and Utilities Board Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the General Regulation - Energy and Utilities Board Act.
Definition of “Act”

1.1In this Regulation, “Act” means the Energy and Utilities Board Act.

Conflict of interest
2(1)A person who is appointed as a member of the Board or who is an employee of the Board
(a) shall not have a direct or indirect legal or beneficial interest in, or commercial affiliation with, a public utility or any other person regulated by the Board,
(b) shall not, at the time of initial appointment to the Board, have been an employee of a public utility or any other person regulated by the Board under any Act in the two years previous to being appointed to or employed by the Board, or
(c) shall not be employed in any capacity by a public utility or any other person regulated by the Board under any Act while serving as a member or employee of the Board.
2(2)A member of the Board shall not be employed in the public service of New Brunswick.
2(3)For the purposes of paragraph (1)(a),
(a) an interest held as the beneficiary of a trust that does not permit the beneficiary to have any knowledge of the holdings of the trust is not a legal or beneficial interest, and
(b) an interest in a mutual fund is not a legal or beneficial interest.
2(4)For the purposes of paragraph (1)(a), a person has a commercial affiliation with another person if the person supplies goods or services or receives goods and services from the other person.
2(5)The use or purchase for personal or domestic purposes of any product or service from a person regulated by the Board under any Act is not a contravention of subsection (3), and does not disqualify a member or employee from acting in any manner affecting that person.
Disclosure and divestiture
3Where a Board member or employee acquires an interest referred to in paragraph 2(1)(a) otherwise than voluntarily, the member or employee shall
(a) advise the Board at once of the interest, in writing, and
(b) divest himself or herself of the interest as soon as reasonably possible.
Witness and travel expenses
4A witness before the Board shall be paid the amount of money allowed in The Court of King’s Bench of New Brunswick to a witness for travel and attendance.

Matters that may be determined by one member of the Board

5For the purposes of paragraph 27.1(1)(k) of the Act, any matter that relates to Part 7 of the Electricity Act or the regulations relating to that Part, including, without limitation, the following, is a matter that may be heard, determined or otherwise dealt with by one member of the Board:
(a) the approval of reliability standards or of modifications to approved reliability standards, or the retirement of approved reliability standards,
(b) the monitoring and assessment of compliance with approved reliability standards or the enforcement of approved reliability standards, and
(c) the registration of owners, operators or users or the bulk power system, including appeals from registration requirements.
