Under section 31 of the Nursing Homes Act, the Lieutenant-Governor in Council makes the following regulation:

1This Regulation may be cited as the Services and care to be provided to residents of Nursing Homes Regulation - Nursing Homes Act.
2No staff member shall reduce or withdraw his or her services as part of a strike action until provision, deemed reasonable by the Minister, has been made for the continuation of the services and care provided to residents in a nursing home.
3If at any time during a strike action or a pending strike action by nursing home staff, the Minister, or a person designated by the Minister under the Act, deems that the level of services and care normally provided to residents of a nursing home has been or will be jeopardized by such strike action or pending strike action, the Minister, or a person designated by the Minister under the Act, may request from a judge of the Court of King’s Bench of New Brunswick, any order that the Court deems necessary, in the circumstances, for the continuation or restoration of a level of services and care reasonable to maintain the health and well-being of the residents.
