An Act to Amend the
Petroleum Products Pricing Act
Assented to March 29, 2019
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Section 4 of the Petroleum Products Pricing Act, chapter P-8.05 of the Acts of New Brunswick, 2006, is amended
(a) in subsection (1)
(i) in paragraph (b) of the English version by striking out “and” at the end of the paragraph;
(ii) in paragraph (c) by striking out the period at the end of the paragraph and substituting a comma followed by “and”;
(iii) by adding after paragraph (c) the following:
(d) fuel charges, if any, payable to Her Majesty in right of Canada.
(b) in subsection (2)
(i) in paragraph (b) of the English version by striking out “and” at the end of the paragraph;
(ii) in paragraph (c) by striking out the period at the end of the paragraph and substituting a comma followed by “and”;
(iii) by adding after paragraph (c) the following:
(d) fuel charges, if any, payable to Her Majesty in right of Canada.
2The heading “Price change due to taxation” preceding section 15 of the Act is repealed and the following is substituted:

3Section 15 of the Act is repealed and the following is substituted:
15(1)If a change in taxation or change in fuel charges payable to Her Majesty in right of Canada causes a change with respect to the wholesale or retail price of a petroleum product, the Board shall be deemed to have issued an order approving the price resulting from the change in taxation or fuel charges on the date on which the change in taxation or fuel charges is to be effective.
15(2)This section applies only if the change in the wholesale or retail price of the petroleum product is wholly attributable to the change in taxation or fuel charges.
CONSEQUENTIAL AMENDMENT AND COMMENCEMENT
Regulation under the Petroleum Products Pricing Act
4New Brunswick Regulation 2006-41 under the Petroleum Products Pricing Act is amended by adding after section 13 the following:
Fuel charges
13.1The fuel charges payable to Her Majesty in right of Canada shall be the amount of those fuel charges payable by a wholesaler or retailer in respect of a type of heating fuel or motor fuel and shall be expressed in Canadian cents per litre or other unit of measurement appropriate to the petroleum product.
Commencement
5This Act comes into force on April 1, 2019.
