REGULATION 82-20
under the
Fire Prevention Act
(O.C. 82-99)
Filed February 11, 1982
Under section 30 of the
Fire Prevention Act
, the Lieutenant-Governor in Council makes the following Regulation:

This Regulation may be cited as the
Fire Prevention and Inspection Regulation - Fire Prevention Act
.

The building standards and fire prevention standards contained in the documents referred to in paragraphs (a) to (e) are the building standards and fire prevention standards prescribed for the purposes of the Act and shall be incorporated in and form a part of this Regulation:

)
National Fire Code of Canada 1995;
(
b
)
Repealed: 97-31
(
c
)
National Fire Protection Association Handbook of Fire Protection
, 17th Edition;
(
d
)
NFPA 395-1993 of the National Fire Protection Association, “Standard for the Storage of Flammable and Combustible Liquids on Farms and Isolated Construction Projects”; and
(
e
)
the following parts of the National Building Code of Canada 1995:
(i
)
Part 1 - Scope and Definitions,
(ii
)
Part 2 - General Requirements,
(iii
)
Part 3 - Fire Protection, Occupant Safety and Accessibility,
(iv
)
Part 4 - Structural Design,
(v
)
Part 5 - Environmental Separation,
(vi
)
Part 6 - Heating, Ventilating and Air-Conditioning,
(vii
)

Foamed plastic insulation shall not be used
(
a
)
on floor areas, as defined in the National Building Code of Canada, 1995,
(
b
)
inside mechanical equipment, such as pipes, air handling equipment or air ducts,
(
c
)
inside the ceiling space between a suspended ceiling and the structural deck, or
(
d
)
inside crawl spaces,
unless it is protected by the application of an approved non-combustible material referred to in section 4 which has a thermal barrier with properties equivalent to a fire resistance rating of at least fifteen minutes when tested in accordance with Standard S101 of the Underwriters’ Laboratories of Canada.

For the purposes of section 3, the following materials are approved non-combustible materials:
(
a
)
plaster (cement or base coat) that is nineteen millimetres thick;
(
b
)
gypsum board that is at least sixteen millimetres thick; or
(
c
)
any other material which the fire marshal approves.

A non-combustible material referred to in section 3 shall be mechanically fastened to the supporting structure, unless it can be demonstrated on the basis of fire tests acceptable to the fire marshal that such fasteners are not necessary.

Notwithstanding section 3, foamed plastic insulation may be used
(
a
)
inside masonry cavity walls which are suitably fire stopped,
(
b
)
under concrete floor slabs on grade, or
(
c
)
as roof insulation applied above the structural deck.

The fire marshal may approve any oil fired unit designed for heating or cooking which has been tested, listed and labelled by the inspection services of the Canadian Standards Association, the Underwriters’ Laboratories Incorporated, the Underwriters’ Laboratories of Canada or any other recognized laboratory or testing agency acceptable to the fire marshal.

The fire marshal may
(
a
)
make such reports and forms deemed necessary for the proper administration of this Regulation, and
(
b
)
modify any form made pursuant to paragraph (a).

Regulation 76-14 under the Fire Prevention Act is repealed.
