Under section 63 of the Early Childhood Services Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the On-line Registry RegulationEarly Childhood Services Act.
Definitions
2The following definitions apply in this Regulation.
“Act” means the Early Childhood Services Act.(Loi)
“extended hour services” means services provided at a licensed facility after 12 consecutive hours of services have been provided or after services have been provided for five days in a week. (services de garde prolongés)
“overnight services” means services provided at a licensed facility between 8 p.m. and 6 a.m.(services de garde de nuit)
Establishment of an on-line registry
3An online registry is established on May 31, 2021.
Information with respect to operators
4(1)An operator of a licensed facility shall provide the Minister with the following information for the on-line registry:
(a) the name of the facility;
(b) the name of the operator, the administrator or both;
(c) whether the operator is an individual, corporation, unincorporated association, partnership or limited partnership;
(d) the e-mail address of the operator;
(e) the physical and mailing address of the facility;
(f) the language in which services are provided;
(g) the licence number or facility identification number and the expiry date of the licence;
(h) the school district within which the facility is located;
(i) the age groups of children who may receive services;
(j) the days and months of operation;
(k) extended hour services and overnight services offered, if applicable;
(l) the curriculum framework in use, if applicable;
(m) whether meals are provided;
(n) whether transportation is provided;
(o) the maximum number of children who may receive services and the number of available spaces by age group;
(p) the designation status.
4(2)The Minister may disclose to the public the information referred to in subsection (1).
Time for providing information
5(1)The information for the on-line registry shall be provided on or before June 30, 2021.
5(2)Despite subsection (1), an operator who is issued a licence on or after June 1, 2021, shall provide the information for the on-line registry within 30 days of the issuance of the licence.
Information with respect to children
6The Minister may disclose to the operator of a licensed facility chosen by the parent or guardian of a child the following information in the on-line registry with respect to the child on the enrolment of the child at the facility:
(a) the names of the child and the child’s parents or guardians;
(b) the gender and date of birth of the child;
(c) the addresses of the child and the child’s parents or guardians and the living arrangements of the child;
(d) the e-mail address and telephone number of the child’s parents or guardians;
(e) the preferred official language of communication of the child’s parents or guardians;
(f) the places of work of the child’s parents or guardians;
(g) the names of individuals authorized by the child’s parents or guardians to pick up the child;
(h) the number of days per week that services are required;
(i) emergency contacts for the child, including names, addresses and telephone numbers;
(j) special requirements of the child, including activity and dietary restrictions, if applicable;
(k) the school that the child attends, if applicable;
(l) allergies of the child, if applicable;
(m) the name, address and telephone number of the medical practitioner of the child, if applicable;
(n) the medical history of the child;
(o) ongoing medical treatment of the child, if applicable;
(p) child care history;
(q) child development details; and
(r) likes and dislikes of the child and suggestions to facilitate the transition to the facility.
Commencement
7This Regulation comes into force on May 31, 2021.
