1The enacting clause of New Brunswick Regulation 99-60 under the Gas Distribution Act, 1999 is amended by striking out “Board of Commissioners of Public Utilities” and substituting “New Brunswick Energy and Utilities Board”.
2Section 1 of the Regulation is amended by striking out “Gas Distribution and Marketers’” and substituting “Gas Marketers’”.
3Section 2 of the Regulation is repealed.
4Section 3 of the Regulation is repealed.
5Section 4 of the Regulation is repealed.
6Section 5 of the Regulation is repealed.
7Section 6 of the Regulation is repealed.
8Section 7 of the Regulation is repealed.
9Section 8 of the Regulation is repealed.
10Section 9 of the Regulation is repealed.
11Section 10 of the Regulation is repealed.
12Section 11 of the Regulation is amended
(a) by repealing subsection (1) and substituting the following:
11(1)Unless the Board otherwise orders, an application for a certificate under subsection 61(1) of the Act shall be accompanied by the following information:
(a) the legal name and business address and telephone number of the proposed certificate holder;
(b) the business classification of the proposed certificate holder as among sole proprietorship, partnership, joint venture, corporation or other form of enterprise;
(c) the legal name and business address of any affiliate or associate of the proposed certificate holder who markets gas in Canada, as these terms are defined in the Business Corporations Act;
(d) the names and addresses of all directors, officers and partners, as the case may be, of the proposed certificate holder;
(e) the details of any licence, permit, certificate or other form of authorization that the proposed certificate holder or its affiliates or associates hold to sell or market gas in Canada, including the date of issuance of the licence, permit, certificate or other form of authorization and the term of the licence, permit, certificate or other form of authorization; and
(f) a detailed business plan of the proposed certificate holder for the sale or marketing of gas within the Province.

(d) by repealing subsection (4);
(e) by repealing subsection (5);
(f) by repealing subsection (6);
(g) by repealing subsection (7);
(h) by repealing subsection (8);
(i) by repealing subsection (9);
(j) by repealing subsection (10);
(k) by repealing subsection (11);
(l) by repealing subsection (14);
(m) by repealing subsection (15);
(n) by repealing subsection (16);
(o) by repealing subsection (17).
13Schedule 1 of the Regulation is repealed.
14Schedule 2 of the Regulation is repealed.
15Schedule 3 of the Regulation is repealed.
16Schedule 4 of the Regulation is repealed.
17Schedule 5 of the Regulation is repealed.
18Schedule 6 of the Regulation is repealed.
