1Subsection 14(3) of New Brunswick Regulation 2009-20 under the Seafood Processing Act is repealed and the following is substituted:
14(3)A copy of the notice of appeal shall be served on the Registrar or the inspector, as the case may be, at the same time and in the same manner as the notice of appeal is served on the Chair.
2Section 15 of the Regulation is repealed and the following is substituted:
15A notice of appeal shall be accompanied by a fee of $1,000 which shall be refunded if the decision of the Registrar or the inspector, as the case may be, is not confirmed.
3The heading “Registrar is party to appeal” preceding section 18 of the Regulation is repealed and the following is substituted:
Registrar or inspector is party to appeal
4Section 18 of the Regulation is repealed and the following is substituted:
18The Registrar or the inspector, as the case may be, is a party to the appeal and is responsible to present a case in support of any decision made by him or her.
5Subsection 20(1) of the Regulation is amended by adding “or the inspector, as the case may be” after “Registrar”.
6The heading “Appeal not a stay of the Registrar’s decision” preceding section 23 of the Regulation is repealed and the following is substituted:
