1Subsection 4(1) of New Brunswick Regulation 2000-4 under the Society for the Prevention of Cruelty to Animals Act is amended
(a) in the portion preceding paragraph (a) of the French version, by striking out “quiconque en a la possession ou en a la charge et le contrôle” and substituting “quiconque en a la possession, la garde et la surveillance”;
(b) in paragraph (c) of the French version, by striking out “et” at the end of the paragraph;
(c) by repealing paragraph (d) and substituting the following:
(d) shall not confine the animal to an enclosure, area or motor vehicle that might reasonably be expected to threaten the animal’s health or well-being due to
(i) inadequate space,
(ii) unsanitary conditions,
(iii) inadequate ventilation,
(iv) the presence of another animal that may pose a danger to it,
(v) lack of opportunity for exercise, or
(vi) a state of disrepair.
2The Regulation is amended by adding after subsection 4(1) the following:
4(1.01)A person who has ownership, possession or care and control of a dog shall not tether the dog outdoors for more than 30 minutes between the hours of 11 p.m. and 6 a.m., unless the person is outdoors and within 25 m of the dog.
3Schedule A of the Regulation is repealed and the following is substituted:
