1The enacting clause of New Brunswick Regulation 84-166 under the Fisheries Development Act is amended by striking out “Fisheries Development Act” and substituting Fisheries and Aquaculture Development Act.
2Section 1 of the Regulation is amended by striking out “Fisheries Development Act” and substituting Fisheries and Aquaculture Development Act.
3Section 2 of the Regulation is amended by repealing the definition “Act” and substituting the following:
“Act” means the Fisheries and Aquaculture Development Act;
4Section 4 of the Regulation is amended
(a) by adding after subsection (1) the following:
4(1.1)On the recommendation of the Board that an application be granted, the Minister may, without the approval of the Lieutenant-Governor in Council, provide direct loans in amounts of up to $100,000 per application to aid and encourage the establishment or development of aquaculture in the Province, except where that loan would constitute an additional disbursement under a previous loan approved by the Lieutenant-Governor in Council under subsection 3(1.1) of the Act.
(b) in paragraph (2)(a) by striking out “subsection (1)” and substituting “subsections (1) and (1.1)”.
5Section 5.1 of the Regulation is amended by striking out “fisheries” and substituting “fisheries or aquaculture operation”.
6Subsection 10(1) of the Regulation is amended by striking out “fishery” and substituting “fishery or aquaculture operation”.
7Section 15 of the Regulation is repealed and the following is substituted:
15(1)Each member of the Board who is not employed in the Civil Service as defined in the Civil Service Act is entitled to remuneration of $100.00 for each day or portion of each day that he or she attends meetings of the Board.
15(2)If the Chair is not employed in the Civil Service as defined in the Civil Service Act, the Chair shall receive an additional $25.00 for each day or portion of each day that he or she attends meetings of the Board.
15(3)If the Vice-Chair is not employed in the Civil Service as defined in the Civil Service Act, the Vice-Chair shall receive an additional $25.00 for each day or portion of each day that he or she attends meetings of the Board on behalf of the Chair.
15(4)Each member of the Board is entitled to be reimbursed for travelling and living expenses incurred by the member in the performance of his or her duties in accordance with the Travel Directive of the Board of Management.
8This Regulation comes into force on September 15, 2009.
