Municipalities Act

1Section 2 of New Brunswick Regulation 84-85 under the Municipalities Act is amended
(a) in the French version in the definition « agent de contrôle des chiens » by striking out “le Ministre” and substituting “la Société”;
(b) in the English version by repealing the definition “Dog Constable”;
(c) by repealing the definition “Municipal Representative”;
(d) in the English version by striking out the period at the end of the definition “running at large” and substituting a semicolon;
(e) in the English version by adding the following definition in alphabetical order:
“Dog Control Officer” means a person appointed by the society to carry out the functions of this Regulation;
(f) by adding the following definition in alphabetical order:
“society” means society as defined in section 0.1 of the Society for the Prevention of Cruelty to Animals Act.
2Section 4 of the Regulation is amended
(a) in subsection (1)
(i) in paragraph (a) by striking out “Municipal Representative” and substituting “society or a Dog Control Officer”;
(ii) by repealing paragraph (b) and substituting the following:
(b) pay to the society or the Dog Control Officer a licence fee of
(i) ten dollars for a female dog, and
(ii) five dollars for a male or a spayed female dog.
(b) in subsection (6) by striking out “Municipal Representative” and substituting “society or the Dog Control Officer”;
(c) in subsection (7) by striking out “Municipal Representative” and substituting “society or a Dog Control Officer”.
3Section 5 of the Regulation is amended
(a) in subsection (1) of the English version
(i) by striking out “the Dog Constable shall” and substituting “a Dog Control Officer shall”;
(ii) by striking out “the Dog Constable is” and substituting “the Dog Control Officer is”;
(b) in subsection (2)
(i) by striking out “the Dog Constable may during daylight hours” and substituting “a Dog Control Officer may during daylight hours”;
(ii) in the English version
(A) by striking out “the Dog Constable is not so satisfied” and substituting “the Dog Control Officer is not so satisfied”;
(B) by striking out “the Dog Constable may cancel” and substituting “the Dog Control Officer may cancel”.
4Subsection 6(3) of the English version of the Regulation is amended by striking out “The Dog Constable” and substituting “A Dog Control Officer”.
5Section 7 of the Regulation is amended
(a) in subsection (4) of the English version in the portion preceding paragraph (a) by striking out “The Dog Constable” and substituting “A Dog Control Officer”;
(b) in subsection (5)
(i) in the portion preceding paragraph (a) of the English version by striking out “Dog Constable” and substituting “Dog Control Officer”;
(ii) in paragraph (a) by striking out “at the office of the Municipal Representative” and substituting “at the regional office of the Department of Local Government for the region in which the dog was seized”;
(c) in subsection (6) of the English version by striking out “Dog Constable” and substituting “Dog Control Officer”;
(d) in subsection (7) of the English version by striking out “Dog Constable” and substituting “Dog Control Officer”;
(e) by repealing subsection (8) and substituting the following:
7(8)When destroying a dog under this section which has not been claimed by the owner or anyone on behalf of the owner, the Dog Control Officer shall do so in a humane manner in accordance with the standards or codes of conduct, practice or procedure specified in Schedule B of New Brunswick Regulation 2000-4 under the Society for the Prevention of Cruelty to Animals Act.
6Section 8 of the Regulation is amended
(a) in paragraph (2)(a) by striking out “the Dog Constable” and substituting “a Dog Control Officer”;
(b) in subsection (3)
(i) by striking out “the Dog Constable may” and substituting “a Dog Control Officer may”;
(ii) in the English version by striking out “the Dog Constable shall issue” and substituting “the Dog Control Officer shall issue”;
(iii) by striking out “Municipal Representative” and substituting “society”;
(c) in subsection (4) by striking out “by the Minister or by the Registrar” and substituting “by the society”.
